exactly my problem, i want to set colours but allow users to change them.

Here is how i figure the above example would/could work:
we accept that shapes have default properties,
(such as how rounded the corners of a rectangle should be)
we inlcude a default foreground and background colour as part of the
default properties of every shape.
If you dont set/change the default colours they would match/inherit from
the ones shown in the colour box (ie black 'n' white).
If the currently selected shape has custom foreground and background
colours the palette would change to show them, but if you switched to
another shape they would change back.

I am not sure i am making this entirely clear, so please allow me to take
another context.
Try coloured text in a(n Abi)Word Processor or Mozilla Composer for
example.
in a sentence that has black and red text the font colour chooser will
show the colour as black but if you put the cursor in the middle of a red
word it will change to show that the text is red.
