There is dispute over what the exact status is, but the general answer
is that AES submissions only have to agree to give up rights IF THEY
ARE ACCEPTED. RC6 is not yet the AES, so it is still proprietary.

RC4 is not a comparable algorithm. It is a stream cipher.
