I would like to start a global requestioning of patents and their validity.
All countries are not the same and therefore the Geneva conventions for
intellectual property rights cannot be applied as some countries apply make
or break the rules which are favourable to themselves. After all these
instruments to gain legalised monopoly which in itself is questionable as
far as trade practices are concerned. As in many countries, the justice
system can be swayed by popular opinion such as we have seen over the past
24 months on CNN. Often legal folk say there is no such thing as justice,
just good and bad legal people.
In particular the USA is trying to change many governments to adopt their
standards pertaining to intellectual property rights. This could be regarded
as unfair practice as it favours the USA, paticularly where entrpeneurs and
inventors in other countries have not access to patents for software.
It could be interesting to start voting globally on such issues, as it is a
world wide issue which is inconsistent. Many would be in favour of
considering information which is made an open standard or public knowledge,
without legal rights, as it is public domain. One would not like to see the
entrepeneural spirit dulled or even squashed but encouraged, but through
fair practice. It is unfortunate that the larger corporations have the same
rights which initself is unfair.
